These Terms and Conditions ("Terms") govern your access to and use of the CarZoum mobile application, website, and related services (collectively, the "Service") provided by CarZoum, Inc. ("CarZoum", "we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By downloading, installing, or using the CarZoum app or website, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
To use CarZoum, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the Service under applicable law
- Provide accurate, complete, and current registration information
CarZoum reserves the right to deny access to any person who does not meet these requirements.
3. The Service
CarZoum is a technology platform that connects independent drivers with riders seeking transportation. CarZoum is not a transportation company and does not provide transportation services directly. Drivers using the platform are independent contractors, not employees, agents, or partners of CarZoum.
CarZoum's unique feature β the ability for riders to view and select from available vehicles on a map before requesting a ride β is provided as-is and is subject to driver availability in your area.
4. Accounts & Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You are responsible for all activity that occurs under your account.
- You must notify CarZoum immediately of any unauthorized use of your account.
- You may not create more than one account, transfer your account, or use another person's account.
- CarZoum may verify your identity, phone number, or other information at any time.
5. Rider Terms
As a rider, you agree to:
- Provide accurate pickup and drop-off locations
- Be present at the designated pickup location at the confirmed time
- Treat drivers with respect and comply with their reasonable requests
- Not engage in discriminatory, harassing, or threatening behavior
- Not request rides for illegal purposes
- Pay all applicable fares and fees as displayed before confirming your ride
- Be responsible for any damage you cause to a driver's vehicle
Riders who violate these terms may have their accounts suspended or permanently deactivated.
6. Driver Terms
Drivers using the CarZoum platform acknowledge that they are independent contractors and agree to:
- Maintain a valid driver's license and vehicle registration at all times
- Carry legally required insurance coverage for transportation network company (TNC) drivers
- Keep their vehicle in safe, clean, and operational condition
- Comply with all applicable traffic laws and regulations
- Treat all riders with courtesy and professionalism
- Not discriminate against riders based on race, color, religion, sex, national origin, disability, or any other protected characteristic
- Accept responsibility for their conduct during trips
CarZoum pays drivers a fair per-mile rate for every completed trip. Compensation details are provided in the Driver Agreement.
7. Payments & Fees
- Fare Display: The estimated fare is displayed before you confirm your ride. Final fares may vary based on actual distance, time, or applicable surcharges.
- Payment Methods: CarZoum accepts credit cards, debit cards, and other payment methods as made available in the app.
- Cancellation Fees: A cancellation fee may apply if you cancel a confirmed ride after a driver has been dispatched, as outlined in the app.
- Receipts: An itemized receipt will be sent to your registered email after each completed trip.
- Disputes: Fare disputes must be submitted within 7 days of the trip via the in-app support feature.
- No Hidden Fees: CarZoum does not charge hidden fees. All applicable charges are disclosed before ride confirmation.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of any regulations
- Harass, abuse, threaten, or intimidate any other user
- Interfere with or disrupt the integrity or performance of the Service
- Attempt to gain unauthorized access to any part of the platform
- Reverse engineer, decompile, or disassemble any part of the app
- Use automated tools, bots, or scripts to interact with the Service
- Create fake accounts or provide false information
- Use the Service to transport illegal substances or for human trafficking
9. Limitation of Liability
To the fullest extent permitted by applicable law, CarZoum shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to:
- Personal injury or property damage arising from a trip
- Loss of data or unauthorized access to your account
- Conduct of drivers or riders on the platform
- Service interruptions or technical errors
CarZoum's total liability for any claim arising from these Terms shall not exceed the greater of $100 or the amount you paid to CarZoum in the 12 months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless CarZoum and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another person or entity.
11. Termination
CarZoum reserves the right to suspend or permanently deactivate your account at any time, with or without notice, for any reason including violation of these Terms. You may close your account at any time by contacting support. Upon termination, your right to use the Service ceases immediately.
12. Disputes & Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, USA, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in Connecticut, except that either party may seek injunctive relief in a court of competent jurisdiction for matters involving intellectual property or urgent equitable relief.
13. Changes to Terms
CarZoum may update these Terms from time to time. We will notify you of material changes via the app or by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.
